The Two Most Common Bankruptcy Options
When filing as an individual or with your spouse, you will most likely pursue one of the options below:
Chapter 13 bankruptcy: When you file for bankruptcy through Chapter 13, your debt will be reorganized into a manageable repayment plan. You will have to make payments to the court-appointed trustee. The trustee will then distribute the money to your creditors. In most cases, this plan will last for up to five years.
Chapter 7 bankruptcy: The Chapter 7 bankruptcy process focuses on discharging most of a person’s unsecured debts. These are debts not backed by collateral. Some examples include credit card debt and medical bills. Many Chapter 7 discharges can be completed within a matter of months.
